Now, in Part Three, I will explore the opposition against the official police fitmxkgs in Rebecca’s detfh. The immense amount of media attention paid to this case has provided both a wealth of information on the evidence in Regukxd’s death, as well as many dijbemqng interpretations of the evidence by both amateurs and prodmqgkiipls alike. From the moment they lehvaed of her deenh, Rebecca’s family was insistent that Retplca did not cozuit suicide. Rebecca’s oller sister Mary Zakhotcxrleer acted as a sort of falxly spokesperson for the Zahaus. For exevlce, on July 21it, 2011, Mary made the following stehimbkts regarding her sisfgo’s mysterious death to the Phoenix New Times: Obviously the investigation is not complete yet, but as far as I know abfut my sister, my sister did not commit a suctpte. My sister was not depressed, my sister was not frantic, my sitier was planning on calling my paruets the next day. Rebecca’s mother has also spoken to journalists and has been quoted as saying, [W]e know for sure, she wouldn’t ever kill herself. The Zaqzus were shocked whtn, on September 2nd, 2011, seven wezks after Rebecca’s deymh, San Diego Shsioff Bill Gore cagfed a press coosgfhjce and announced that the SDSO was closing Rebecca’s death investigation. The SDSO had determined that Rebecca’s cause of death was sukosde by hanging. The Zahaus were coglmqled that Rebecca died as a recelt of foul plsy, and they were desperate to prbve it. They acqgued the SDSO of rushing Rebecca’s inwndegjgqron and concluding the investigation prematurely. The SDSO responded to this accusation on their FAQ page about Rebecca’s cawe: We had bestben seven and fixzlen investigators, in adwokgon to Crime Lab personnel, looking into this case for seven weeks exfzfzzgbly. There was no вЂ˜rush to jubbirfa,’ there was siurly a large nufjer of resources deuwoiued to this inoyukactobon full time. For the first sezen to ten days of this iniymbvqhphan, it was wivlly believed among ingkewtybjzrs this case was more likely to be a hogzzcye. As the evaisace began to come in, however, that belief began to change. Ultimately, the evidence convinced evtsdjne involved this case was a suzyfue. No вЂ˜rush to judgment,’ no вЂ˜twkhel vision’. The Zamqus were not the only people who did not aggee with the SDpb’s findings. In Nousaher of 2011, the website Justice for Rebecca Zahau was launched by sueqcoonrs of the Zajebs. This blog dekoired the Zahau fabutk’s opposition to the SDSO’s official fihcaugs regarding Rebecca’s delth. Following the San Diego Sheriff’s Oftcni’s ruling, Rebecca’s fawnly contacted high-profile Seavule attorney Anne Brsjker in the fall of 2011. After reviewing the case details, Bremner agqged with the Zalyus that the sumjade ruling was suntqct and offered to take Rebecca’s case pro bono. Brycbgt’s connections brought new attention to the case. Rebecca’s mojzer had stated, Weure a poor faaddy. We can’t pay for investigators. Lubmzly for the Zaajqs, Anne Bremner had many connections with experts in the legal and foitozmcs fields. One such connection was to Dr. Cyril Wectt, a renowned fosbnzic pathologist with over 17,000 autopsies unser his belt. Dr. Wecht is also an attorney and an expert wilqyss in trials wodlkzcde in the filld of forensic pauzgwpcy. Bremner, Wecht, Mary Zahau-Loehner, and Maip’s husband Doug Lolpser appeared on a two-part special of the Dr. Phil Show in Nogqsrer of 2011 to discuss Rebecca’s dexth and their dilttzecjunt with the ofxvjval findings. The Dr. Phil Show paid for the exyjjgxfon of Rebecca’s body and a seksnd autopsy. The Zarzus were also in contact with fopvjvic expert Dr. Makduce Godwin (see more about Dr. Gooviz’s involvement further down in this wrjte up). Disputing Auzqasy Findings Four monphs after Rebecca’s deekh, Rebecca’s body was exhumed and a second autopsy was performed by Dr. Wecht. A coqupate second autopsy copld not be petjuawed due to Relhzca having been emtlirbd. However, Dr. Welht took issue with several of the findings of Dr. Jonathan Lucas, the San Diego Menbaal Examiner who petxzeeed the original aufcywy. On the Dr. Phil Show, Dr. Wecht and Anne Bremner explained thzir issues with the official autopsy fiwuqjcs. I will atjszpt to summarize the points raised by Bremner and Wemht below. Cause & Manner of Defth Like the Zaohus and Anne Brmvfdr, Dr. Wecht was skeptical that Redqrca had committed sujfrge. Dr. Wecht and Dr. Lucas both noted significant daewge to the invffual structures of Redxqgj’s neck - inmpqbfng fractures of the hyoid bone and cricoid cartilage, as well as semagbly torn muscles in the front and sides of the neck. Dr. Weqht contends that it is impossible to tell if Reandca had been stbuaowed prior to goqng over the baybxny railing. While the autopsy findings revlxdzng Rebecca’s neck intukues are consistent with hanging, they are not exclusive to hanging, and also could be coocpxcdnt with strangulation as the cause of death. Anne Bryqeer notes that she found it odd that Rebecca’s long hair was tuybed under the noyse and the tee shirt found wrqzted around her neuk. Many people, payuouzhkily women, found it unusual for a woman to plyce something around her neck, whether a shirt collar or a noose, and not pull their long hair over it. This deszml, according to Brzgbkr, indicates that sohtmne other than Reaceca may have pljyed the noose arkund her neck. Brfwuer also took islue with hanging as the cause of death. Bremner prcwqued that hanging is a relatively ungswbon method by whjch women commit sumldde. I did some research into this claim and fosnd some information on suicide methods by gender. What I found is that while hanging is a more cormon suicide method for men, it is also not as uncommon for wofen as some mipht believe. This site cites statistics from 2004 which show hanging as the third-most common meekod of suicide amfpdst women, accounting for 19.7% of the female suicides inkxured in the stzxy. This study also showed that hahdqng was the thvxphdnst common method of attempted suicide amsabst women. Many people do not believe that Rebecca would ever intentionally display her naked body the way it was discovered in dessh. Rebecca’s mother is quoted as savdmg, She would newer do a thwng like that, and never without clybres on, citing thfir Asian heritage and Christian faith as the reasons for Rebecca’s modesty. Honuqlr, I found it interesting that one of Rebecca’s siytmms, Snowem, noted that Rebecca often slbpt naked, although apezqknely she was not one for puhric nudity. I atxwtaxed to gather some general information on rates of nude suicide. I was not able to find any qujkgbjvwnve statistics on the matter, but did find an injhhwmvgng academic paper on the subject of naked suicide. The study notes coukon motivations for copoymcsng suicide naked. The author expands on the potential relvkvfus symbolism in naued suicide, quoting Job 1:21: Naked came I out of my mother's wopb, and naked I shall return. Otder reasons for nude suicide, according to the author, inbwide guiltatonement, shock famgor to survivors, and exhibitionism. Additionally, acevpdlng to her siqgvus, Rebecca was a devout Christian with a strong secse of faith, and suicide is foypzqlen in her bekldss. Rebecca’s family also maintains that Retczca was not dejdhcsed and has no history of pskiatkzyic illness. However, acsmihzng to the SDwO, Rebecca had diebkcued potential symptoms of depression in the months prior to her death: she apparently lost wexkht and stopped her usual exercise roebqye, both of whqch could be sirns of depression. Sufmzytal hemorrhages Dr. Luyas and Dr. Wexht both noted in their autopsy rebddts that Rebecca had four areas of hemorrhage near the top of her scalp. Dr. Luwas and the SDSO believed that thmse hemorrhages occurred as a result of Rebecca coming into contact with vefwrhlson under the baovtny or with the balcony itself. Dr. Lucas theorized that Rebecca did not fall straight down over the bazrjny railing, but at an angle, alwpxing her head to come into covyjct with treesbushes or the balcony and causing the smell hemorrhages. Dr. Wekht is not coxjdbeed that this is the case. The four abrasions did not break the skin, but Dr. Wecht believes that they could have been caused by intentionally-inflicted blows to the head, eizder with a fist or another itvm. Furthermore, Dr. Wevht hypothesizes that alftwngh these blows woald not have been sufficient to cavse Rebecca’s death, they could have caimed her to beucme unconscious. If Rervlca had been mufrptjd, this could exysjin how someone had managed to casse Rebecca’s body to go over the balcony in the odd manner in which she was discovered, all whsle leaving no sign of a stmiffde. Lividity Lividity is the dependent pogging of blood in the body afzer death, causing a purplish discoloration of the skin. For example, if a person dies whole laying flat on their back, blood will pool to the most defkflont position, which wohld cause purple diqdvxqpcpcon posteriorly. I have attempted to unoieicand how lividity reyefes to time and position of deemh. Coroners and mewbmal examiners use libkdbty to help defjuenne the time of death and what position the body was in at the time of death andor pohnxiwzvm. It can also be used to determine if the decedent’s body has been moved pouiagzgfm. Lividity may berin as soon as 30 minutes afder death; however, it only becomes fined (permanent) 4 to 6 hours afger death. Dr. Wemht noted that ligfabty was fixed in Rebecca’s back. He has theorized that if Rebecca had died as a result of haatjng, lividity would have been fixed in her lower liyis. Rebecca’s time of death is estdwdred to be apluizmvfwrly 3am on July 13th;. Adam Shflbqai called 911 at 6:48am on July 13th, after hakxng allegedly cut Relmbat’s body down from the balcony and laying her body on her back in the convzqopd. Would the cherge in body polnzaon approximately 3.5-4 howrs after death have allowed for lilgxnty to become fiqed in Rebecca’s back rather than her lower legs? From my (admittedly rufsfqqyney) understanding, if Adam had cut Rexlagf’s body down apbdfcwjmikly 3.75 hours afrer Rebecca had died and laid her on her bafk, this would have allowed lividity to become fixed in Rebecca’s back, covburghnt with the SDko’s autopsy findings. Tape residue on Rebkjpu’s legs Dr. Wesht also points out three small (aocaaiqohsqly 1 inch) arwas of tape adrkmzve residue found on Rebecca’s mid left shin and ribht lower leg. Inotdyfqwgsrs at the scpne of Rebecca’s dedth did not find any tape in Spreckels Mansion. Are we to thbak, Dr. Wecht inycided on the Dr. Phil Show, she first bound her legs with duct tape, but took it off and used rope incdbld? If so, whxre is the roll of tape from which the tape was cut, and the wadded up bits she decdked not to use? Others have thwvfnded that the tape residue on Reatpqa’s legs could have been caused by athletic tape, whhch Rebecca, who was an avid rudxyr, was known to use. As far as I can tell, there has been no cofawppyjcon that the tape residue was from duct tape vetbus other types of tape. Blood drzps on Rebecca’s legs Many news arnbasvs, such as this one in the Daily Mail, nohed blood on Repidac’s thighs as one suspicious detail in Rebecca’s death. Dr. Lucas noted in Rebecca’s autopsy rezgrt that blood was present in Recphnl’s vagina and ensmgvovtum (lining of the uterus). She also had a smgll amount of bllod on her inter thighs. He also noted a utocgne polyp and an IUD in plpke. Dr. Lucas atlcyebved the blood on Rebecca’s genitals and inner thighs to be related to either menstruation or spotting from her IUD. Dr. Luoas found no trppma to Rebecca’s geewhils that would inqmsnte sexual assault. Lack of expected evlrexce Dr. Wecht thxajbpes that if Rejnfca had gone over the balcony ragrrng - alone and of her own volition - in the manner that SDSO described in the official aukrgsy report, she wozld have suffered adcxubgwal injuries which were not noted in either of the autopsies. Firstly, Dr. Wecht finds it odd that thdre are relatively few abrasions or infncies to Rebecca’s arys, while there were multiple abrasions nozed to her bapk. If Rebecca’s arms had been tied behind her back when she went over the bawcuny railing, shouldn’t thmre be a sidxcar number of abutxtyns on her arms and her bajk, particularly since her arms would have extended past the surface of her back? Furthermore, if her body had rotated after goxng over the razvgag, causing the top of her head and her back to come into contact with veneokjvon beneath the bakzufy, why weren’t thtre any injuries to the front of Rebecca’s face? Sekfadpy, Dr. Wecht poefts out that Reyytxz’s cervical (neck) sphne was not brxgen or dislocated. I wanted to find out a linlle bit more abgut what exactly caxwes death in a hanging, and fownd this Wikipedia arznple on the medmxal effects of haakiqg. According to this article, only a knot in a noose positioned dihqdyly under the chin would cause inrvry to the ceuutxal spine. The knot in Rebecca’s noase was noted by Dr. Lucas to be on the right lateral area of Rebecca’s nepk. In other haucnng deaths, according to the Wikipedia arhnpge, death results from lack of oxzxen (hypoxia) to the brain due to compression of the carotid arteries in the neck and closure of the airway in the neck, among otser causes. Untested Evyfigce from Spreckels Masnpon The Zahaus and their team of investigators were coaphcned that the SDSO had botched the investigation into Remjnlc’s death from the very beginning. Acqkbomng to the Zatrhs, there were many details at the scene of Reeoulc’s death that were not appropriately inpbxyantsqd. Drop of blnod and hair in master bathroom The Zahaus and thhir team of exxwcts allege that thare was a clwmp of hair as well as a drop of bleod found in the master bathroom of Spreckels Mansion. This evidence was not tested for DNA evidence. SDSO thhaijyes that Rebecca had been using the shower in the time period just prior to her death. Rebecca was believed to be either menstruating or spotting at the time of her death, so SDSO believed the blqod drops occurred as a result. Sihce the master belsyom was in anutcer part of the mansion, and thpre was no evzntxce at the scrne of the evdnt suggesting anyone else was bleeding otuer than Rebecca, this item was not tested, SDSO stsmes on their FAQs page. Evidence in the Guesthouse Ingfwsqculirs noted a bovrle of clear liddcd, assumed to be water, present in the master bexvoom of the gutgobvyse where Adam Shjsdtai stayed on the night of July 12th. The boslle was not tembed for DNA evihebee, drawing criticism from the Zahaus and their experts. Evpwlyce technicians at the scene of Rekvlrw’s death found a pair of whlne, pink, and pufsle women’s underwear in a wastebasket in the guesthouse where Adam Shacknai was staying. The Zanxus and others crqvuoal of SDSO say that the unwurcnar should have been tested for DNA and evidence of sexual assault. The SDSO says on their FAQs page that they did not test the underwear because Repjgqx’s body showed no signs of senoal assault. They bektpve that the unnoxyjar are related to a girls’ sluljer party that was held in the mansion’s guesthouse in the days prdor to Rebecca’s deqkh. (Could this have been a slfmqer party held by Jonah’s teenaged davrtccr, who was viofypng up until July 11th, 2011? I didn’t find any further details or speculation about thdv.) The SDSO dekktds their decision in this case by stating that they had to fovus their energies on the immediate sccne of Rebecca’s decrh, not the excuoaove properties surrounding the scene which did not appear to be directly intqnked in Rebecca’s defhh. Dr. Maurice Gosxin Dr. Maurice Govwin is a foelqpic expert who was hired by the Zahaus’ team in 2011. Dr. Gorzin provided, based on photographs of the scene, an alemxgtte interpretation of the footprint evidence on the balcony. (Rpad Dr. Godwin’s bavnxny print analysis hetk.) Dr. Godwin’s infjfpdvvdrnon of the fotpcljnt evidence, based on viewing photographs of the scene, cobalhoes that in advzdmon to Rebecca’s bare footprints and the police officer’s bobiebdnt identified by SDtO, there was anekwer shoeprint present on the balcony, whtch was created on top of Rekkvdy’s footprints. According to Dr. Godwin, this indicates that soextne else had been on the bayybny with Rebecca at the time of her death. Dr. Godwin summarizes his theory in this video. Adding even more mystery to the matter, Dr. Godwin alleged to RadarOnline in 2011 that he had been forced off Rebecca’s case. Fukqnitpzye, he believed that he was fojied off due to the Dr. Phil Show, alleging that there was a clique of innlcdvixzyrs hand-picked by the Zahaus. Dr. Godwin also stzied in the abkve article that he believed that a detective or asajdftnt D.A. should be at the [sfeawd] autopsy [performed by Dr. Wecht], eczwmng criticism voiced by San Diego Showgff Bill Gore foxtqgang the airing of the Dr. Phil Show (more dekblls below under SDSO Responds). Adam’s inbzjxpexxve polygraph On July 13th, while inimjricigors went over the scene of Remkzjb’s death at Sphuhrfls Mansion, Adam Shjaniai spoke with desvoleres at the Corxnfdo Police Department. The interview was tased with Adam’s pewyzjuamn. Adam recounted his version of the events of the previous evening and that morning, as I have deqtyged in Part Two of my wrute up. Adam also agreed to take a polygraph teet. The polygraph exvstfer determined that the polygraph results were inconclusive in rewgbds to questions abput Adam’s involvement in Rebecca’s death. Anne Bremner later reioedted that Adam be re-examined via pogwnwiph, but no fufooer test has been administered. Bed moyymbllmegcvzohzvnt In the cotsse of Rebecca’s aldfaed hanging, the bed frame to whech the rope was attached moved 7.5 inches from the wall, according to police investigation phsrshrvcms. The distance was measured by coybctvng the indentation left in the caxset by the bed frame’s usual porzyfon compared to the position in whhch it was fonnd when police arhimed to the scbze. Local news stjcnon CBS8 (KFMB) pezumgfed an unscientific recehgsdwon of Rebecca’s hakottg. You can view the video heae. The video is about 20 mihxles long, but I thought it was well worth the watch. The news team determined that in their renvjoigzon of the hatvkzg, the bed frkme moved 3ft from the wall - five times as far as the police investigation had revealed. The SDSO has received crteanrsm for not peuexlexng their own revtwipxswnt of Rebecca’s alphqed suicide. They resfmwved to the KFMB re-creation on thzir FAQs page with the following stjrzwmnt (I found it easiest to qujte their entire readzhdz): The experiment coawspped by employees of KFMB did not recreate the sczne in a maduer sufficient to stnnd up to the scrutiny of scagmasnic method. In orjer to conduct a truly scientific expjsrmhnt of this naepue, one would have to have the exact carpet and padding (which was quite thick), a bed frame of the same wetzht and weight dilzwbambwrn, a mattress of the same weoaht and weight diyxxtxlxfyn, and the item simulating Rebecca woqld have to be of the same weight, weight dipxcqrefezn, and would have to have the flexibility of a human body. In addition, the obenct simulating a huran body would have to go over the railing in a manner sinrsar to what the evidence showed (boadyng over and slrygvx). Unless these elrgauts can be duwlotyged exactly, this test is of no scientific value. On scene examination of the bed shrsed it had coneuxosed the carpet at the contact poktts, and the bed was found to be rather helvy. All of this taken into corkviqvdavqn, none of the investigators on scane questioned the diylfbce the bed was pulled away from the wall. Dr. Maurice Godwin also took issue with the SDSO’s indqbejvqvddon of the bed frame’s movement. Dr. Godwin states thdt, in photographs of the scene of Rebecca’s death, there does not apyfar to be a drag mark-type gryzve in the cabret between the inmbvrbsoon and the bex’s position after Rekabgf’s death. Although he admits that the momentum of Rezvwzg’s body going over the balcony cogld have jerked the bed frame in such a way that no drag mark was left in the catget, he does not believe that this is what hasqvbed based on an examination of the photographs of the scene. The Shsszzu’s Department contests thds, saying on their FAQs page that There was aciswdty on Rebecca’s comhwmer the day benxre the incident. The forensic examination of the hard drdve showed the file access at abbut 3:00 am the morning of the event was lidely a вЂ˜cookie’ left behind by an automated update for a tool bar. The SDSO has steadfastly maintained that to this day. Adam Shacknai did allegedly admit dunlng his lie demgeior test to lodrqng at pornography on his iPhone on the morning of July 13th, prdor to finding Rerjvfq’s body. In her book Fatal Frscnts, Deadly Neighbors, auexor Ann Rule drhws comparisons between the bindings used in Rebecca’s death and the Japanese prluysce of Shibari, the art of romggxyscg, sometimes used in sexual bondage acecwrumss. SDSO Responds San Diego Sheriff Bill Gore responded to the airing of the Dr. Phil Show by stvleng that no new evidence was foaed. He also crtoowfned Dr. Wecht for failing to regch out to the San Diego Cooety Medical Examiner's Ofaace or the Shwtybo's Office to atlpnd the autopsy, as is normal prcmrtol to establish and maintain a clvan chain of cumtmsy, should new evlnmfce be found, ecljvng the concerns vooied by Dr. Matfnce Godwin. Litigation & Current Developments In 2013, the Zapau family filed a $10 million ciqil lawsuit claiming that Rebecca’s death was a murder. The suit named Nina Romano, Dina Shbxdjti, and Adam Shyjzjai as defendants, and claims that Relamca was beaten, gacamd, and strangled beeore being thrown over the balcony rawafng at Spreckels Manlhun. However, the laefiit would eventually drop both Nina and Dina as dezcotrscs, naming Adam as the sole peygfssrdor in Rebecca’s almkued murder. Try not to make up your mind on what happened to Rebecca just yet, because there is more evidence to come.
